California No Robo Bosses Act: log the human review now
Newsom signed SB 947 and AI workplace laws: no AI-only firings from July 1, 2027, plus emotion-tracking bans. Build the human review log before you need it.
On September 30, Governor Newsom signed California's No Robo Bosses Act (SB 947) as part of a package of AI workplace laws. The headline: an employer can no longer fire or discipline someone on the say-so of an automated system alone. If you run HR, scheduling or performance tooling with any AI in the loop — and you have staff in California — the compliance question is not "do we use AI." It is "can we prove a human checked it."
What actually happened
Per the Governor's office, KQED and the National Law Review, the bills that matter for operators are:
- SB 947 (No Robo Bosses Act): bars relying solely on an automated decision system for discipline or termination. If AI output is the primary basis, a human reviewer must independently corroborate it with other information, and the affected worker gets notice that AI was used. Effective July 1, 2027. Senator McNerney's office says the labor commissioner, attorney general and local prosecutors can enforce it.
- AB 1883: bans workplace surveillance tools that use AI to infer a worker's emotional state or collect neural data. The National Law Review reports penalties of up to $500 per violation, enforceable through PAGA — California's private attorney general statute.
- AB 1331: bans surveillance tools in workplace bathrooms.
- SB 951: requires employers to disclose when a mass layoff, relocation or termination is caused by an AI system. Reports differ on the exact notice period, so read the final bill text before you plan around a number.
Why the No Robo Bosses Act matters for your business
"Primarily" is the trigger, and you need a record. Most small teams do not have a robot firing anyone. They have a productivity dashboard, an attendance score, or an LLM that summarizes complaint tickets — and a manager who acts on it. That is exactly the pattern this law reaches. The fix is cheap if you build it now: when a disciplinary decision touches AI output, write down what else the reviewer looked at. Manager notes. Peer input. The personnel file. Timestamp it.
Audit your vendor's feature list. "Sentiment" and "engagement" scoring in call-center, meeting and monitoring tools can drift into emotion inference. Under AB 1883, that is a per-violation exposure with a private right of action behind it. Ask every HR and monitoring vendor, in writing, whether any feature infers emotional state. Turn off what you can't justify.
Arizona isn't exempt from the trend. We are in Phoenix. If you employ one remote worker in California, these rules follow that worker. And state AI rules tend to get copied.
