ChatGPT is now a search engine under EU law
The European Commission designated ChatGPT a Very Large Online Search Engine under the DSA on August 31. What the ChatGPT VLOSE designation changes for your traffic.
The European Commission has decided what ChatGPT is. Not a chatbot, not an assistant — a Very Large Online Search Engine. The designation landed August 31 and it makes ChatGPT the first generative AI product pulled into the Digital Services Act's heaviest tier, alongside Google Search and Bing. If any part of your revenue arrives through an AI answer, the channel you were treating as an experiment now has a regulator attached to it.
What actually happened
Per the European Commission's announcement, the Commission designated ChatGPT as a VLOSE, and Reddit and Roblox as Very Large Online Platforms. All three declared they reach at least 45 million average monthly users in the EU — the threshold that triggers designation.
The three services have four months from notification to meet the extra obligations, which puts the deadline in early 2027. Those obligations are the expensive part:
- Systemic risk assessment and mitigation across illegal content, effects on minors, users' physical and mental well-being, fundamental rights, electoral processes, and public security.
- An independent audit at least once a year.
- Data sharing with the Commission and national authorities.
- A recommender option that is not based on profiling.
Read that list again with a commercial eye. Two of those four are about how the system ranks and recommends things — and ranking is how your business shows up in an answer.
Why the ChatGPT VLOSE designation matters for your business
We have been telling clients for a year that AI assistants are a referral channel you rent, not a channel you own. The designation does not change that. It changes the shape of the risk, in three specific ways.
Ranking gets audited, which means ranking gets documented. VLOSEs have to explain their recommender systems and submit to annual independent audit. Historically that produces artifacts — transparency reports, risk assessments — that describe how the ranking works in more detail than any vendor blog post ever will. That is free intelligence on a channel that has been a black box. Read those documents when they publish.
A non-profiling recommender option is a new traffic segment. Some share of EU users will browse an answer engine that is not personalizing to them. If your product surfaces today because ChatGPT knows a user's history, that path thins out for those users. The thing that still works is the boring thing: clean, structured, machine-readable product data that makes you the correct answer regardless of who is asking.
Compliance cost travels downhill as feature gating. When a platform takes on a jurisdiction-specific obligation, the cheap engineering answer is to restrict features by region. We have watched this happen with every DSA and DMA wave. If you sell into the EU through an AI surface, assume some capability you depend on gets a regional flag on it, and do not build a checkout flow whose only path runs through somebody else's assistant.
The operator move is unglamorous. Instrument the channel — tag AI referrals in your analytics so you can see the number move instead of guessing. Own the product data that feeds the answer. Keep a direct path to purchase that works when the assistant does not.
