China's AI export controls draft: APIs exempt, weights are not

China's AI export controls draft lists 23 AI technologies, including models and agents. API access looks exempt. Self-hosted Chinese weights carry new risk.

In July, Beijing was only talking about AI export controls. On Friday it put a draft on paper. China's commerce and science ministries proposed adding 40 technologies to the country's export-control catalogue, and 23 of them are AI: models, intelligent agents and computing clusters. If you run a Chinese open-weight model on your own hardware, or plan to, the rules around that model are now moving.

What actually happened

Reuters reports the Ministry of Commerce announced the proposal on October 16 and is taking public comments until November 15. Interim pre-export registration starts now for the listed technologies. The ministry says the change is routine and does not target any country.

The Associated Press gives the split: 23 AI items, 12 solar, 5 biomedicine. The prohibited tier covers core technology for large models trained on sensitive national data, and AI agents built for settings like defense and critical infrastructure. The restricted tier could catch models with 2 trillion or more parameters, or with "world-leading" capabilities. The ministry said the goal is to keep "AI under human control."

TechNode reports that 14 of the 40 items would be prohibited and 26 restricted. It also reports that the ministry's explanation says overseas use through APIs, websites, apps and SaaS would "generally not" count as a technology export, as long as no restricted technology is transferred. That is a draft, and the final text can change.

Why it matters for your business

Read the carve-out carefully. If it holds, calling a Chinese model through a hosted API stays legal from Beijing's side. What the draft targets is the transfer of the technology itself. For model weights, that is the download.

That matters to small teams because self-hosting cheap Chinese open weights became a real cost play this year. A 2-trillion-parameter line is above most of today's open releases. But the "world-leading capabilities" clause has no number in it, and the next big release could land inside it. The models you depend on may keep shipping. They may also ship late, ship smaller, or ship only behind an API.

Our advice from July still holds, and now it has a deadline: keep your model behind your own interface. Keep a second model tested against your evals. Make a model swap a config change, not a rebuild. Then November 15 becomes a news item for you, not an outage.

Key takeaways

  • China proposed export controls on 40 technologies on October 16; 23 are AI, including models, agents and computing clusters
  • Comments close November 15; interim pre-export registration applies now
  • Models with 2 trillion or more parameters, or with "world-leading" capabilities, could be restricted
  • TechNode reports the ministry's explanation treats API, app and SaaS access as generally not an export. Downloadable weights are the exposed part
  • If you self-host Chinese open weights, keep a tested fallback model and make the swap a config change

Is a Chinese open-weight model inside one of your workflows? We build model layers you own: one interface, several tested models behind it, and evals that tell you when a swap is safe. See how we keep your AI portable or have us map your model dependencies before November 15.
