Meta pushes its new terms to Nov. 20. The AI liability clause stays.
Meta's commercial terms now take effect November 20, not October 30. The AI liability clause is unchanged. Audit which Advantage+ AI features you run.
Meta's new commercial terms will not take effect this Friday. The Commercial Terms preview now reads "Effective Date: November 20, 2026," three weeks later than the October 30 date Meta posted on October 19. The delay buys time. It does not change the AI liability language. If you run ads or business messaging on Meta, the clause that makes you own the mistakes of Meta's AI features is still in the text.
What actually happened
When Meta posted the preview, CIO reported an October 30 effective date. Both the Commercial Terms preview and the Self-Serve Ad Terms preview now show November 20 instead.
The AI language is the same on both pages. Meta says its "AI features may make mistakes and may not always produce accurate, complete, or suitable results." Then it says the customer is "solely responsible for and assume[s] any and all risks associated with such AI features."
Two more pieces sit next to that clause in the Commercial Terms preview:
- Indemnity. "To the extent permitted by law," you agree to indemnify Meta against damages, losses and expenses tied to your content and your use of its products.
- Third parties. You are "solely responsible for the acts or omissions of any third-party software or service that you use or authorize." Your agency and your tools are on your side of the line, not Meta's.
We covered the crawling and training fight in two earlier posts (one, two). This post is about the liability half, which got less attention and did not move.
Why Meta's AI liability clause matters for your business
You are accepting risk for features you may not have chosen. Some Advantage+ creative enhancements write text variations and edit images for you. The terms do not name Advantage+, and they do not say whether a feature you never switched on counts. If one of those writes a claim you cannot back up, the terms put that on you.
Three weeks is enough time for an audit. Open Ads Manager. For each live campaign, list which Advantage+ creative enhancements are on. Turn off the ones you do not review. For the ones you keep, have a person approve the output before it runs, the same as any copy your team writes.
Your Meta business agent is now your employee. If you use a Meta AI agent to answer customer messages, write down what it may promise: prices, refunds, delivery dates. Keep the instructions in a document you control, and spot-check transcripts every week.
Read your agency contract next. If an agency runs your ads, the terms make their tools your responsibility. Ask them in writing which AI features they turn on for you.
